Welcome to PlagPointer Plagiarism Checker (“PlagPointer”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of the PlagPointer website and plagiarism scanning service (the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms.
If you do not agree with these Terms, you must immediately cease using the Services.
We may modify these Terms at any time, and such modifications shall become effective upon posting. Your continued use of the Services after any modifications indicates your acceptance of the revised Terms.
1. Eligibility and Registration
To use certain features of the Services, you must create an account by providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for any activities under your account.
You must promptly inform us of any unauthorised use of your account.
2. Licence to Use the Services
PlagPointer grants you a limited, non-exclusive, non-transferable, revocable licence to use the Services solely for personal, educational, or internal business purposes. You may not sublicense, resell, or otherwise distribute access to the Services without our prior written consent.
3. Credits and Payment
Your access to the Services operates on a credit-based system. Each credit allows you to scan one page containing up to 250 words. Credits can be purchased as needed, or via subscription. Pricing details are provided clearly before purchase.
Unused credits from monthly subscriptions do not carry over and are not refundable. Annual subscriptions expire after 12 months from the date of purchase.
4. User Responsibilities
You agree to:
- Use the Services lawfully and in accordance with these Terms.
- Ensure that your use of the Services does not violate the rights of any third parties.
- Not attempt to reverse engineer, modify, or otherwise disrupt the functionality of the Services.
5. Privacy and Use of Documents
Your use of the Services is subject to our Privacy Policy, which outlines how we collect, store, and process your personal data.
When you scan documents using the Services, you retain full copyright ownership. If you choose the ‘Internal Database’ option, a third-party API provider will securely store a copy of your document to enhance future plagiarism checks. You can request deletion of your documents from the internal database at any time, free of charge.
If you do not select the ‘Internal Database’, your documents will not be retained.
6. Intellectual Property
All rights, title, and interest in the Services, including all intellectual property rights, remain solely with PlagPointer or its licensors. Except as expressly provided in these Terms, no licence or rights are granted to you by implication or otherwise.
7. Disclaimer of Warranties
The Services are provided “as is” and without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or completeness of any results generated by the Services.
8. Limitation of Liability
To the maximum extent permitted by English law, PlagPointer shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use or inability to use the Services.
Our total liability under these Terms, for any claim, shall not exceed the amount you have paid us in the twelve months preceding the claim.
9. Indemnity
You agree to indemnify, defend, and hold harmless PlagPointer, its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Services;
- Your violation of these Terms;
- Infringement of third-party rights arising from your content.
10. Confidentiality
Both parties agree to maintain the confidentiality of all non-public information received during the use of the Services, taking reasonable steps to safeguard such information.
11. Third-party Services
Our Services utilise third-party APIs to deliver certain functionalities. While we aim to ensure continuity and accuracy, we cannot guarantee uninterrupted or error-free access to third-party services and disclaim liability arising from their use or availability.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with English law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
